Court Halts Rivers Assembly’s Impeachment Plot Against Fubara

A Rivers State High Court sitting in Oyigbo Local Government Area, Port Harcourt, has halted moves by the Rivers State House of Assembly to impeach Governor Siminalayi Fubara and the deputy governor, Prof. Ngozi Odu.
The court, on Friday, issued an interim injunction restraining the Speaker of the House, Martin Amaewhule, and two others, including the Clerk of the Assembly, from transmitting any correspondence to the Chief Judge of Rivers State in furtherance of the impeachment process.
The court also barred the Chief Judge, Justice Simeon Amadi, from receiving, acting upon, or considering any request, resolution, articles of impeachment or related documents from the lawmakers aimed at constituting a panel to investigate the governor and his deputy over alleged misconduct for a period of seven days.
Justice F.A. Fiberesima, who presided over the matter, granted the orders while ruling on a motion ex parte in two separate suits filed by Governor Fubara and Deputy Governor Odu.
The judge also granted leave for the claimants to serve the interim orders and originating processes in Suit No. OYHC/7CS/2026 and Suit No. OYHC/6/CS/2026 on the 1st to 31st defendants by pasting them at the gate of the Rivers State House of Assembly quarters.
Similarly, the court directed that the processes be served on the 32nd defendant – the Chief Judge of the state – through any judiciary staff at his chambers within the High Court premises.
Justice Fiberesima adjourned the matter to January 23, 2026, for the hearing of the substantive motion.
Despite the court order, the House of Assembly was reported to have resolved on Friday to continue with the impeachment proceedings against the governor and his deputy.
In a related development, four lawmakers who had earlier withdrawn from the impeachment process and urged others to do the same reversed their stance, accusing Governor Fubara of being unyielding.
